Prosecutor: Delivery driver justified in deadly Vancouver shooting | Local News

VANCOUVER, WA (KPTV) – The Clark County attorney declined to bring charges against a delivery man who shot and killed a man in Vancouver last month.

Filming took place in the 700 block of Waterfront Way shortly after 4:30 a.m.

Justyn Vallandingham, 35, was delivering newspapers in the area and had left his vehicle unlocked and ready to drive, according to Vancouver police. When he returned to the vehicle, he found Kin Bossy, 29, in the driver’s seat. Vallandingham pulled out his gun and pointed it at Bossy, who leaned toward the center console of the vehicle. Fearing Bossy could reach for a gun, Vallandingham fired his, according to the VPD.

In a letter to the Vancouver police detective, Assistant District Attorney Jeff McCarty wrote that Bossy appeared to have committed a crime against Vallandingham that feared imminent danger or death. Vallandingham, who has a concealed gun license, told police he thought he was reaching for a gun when he saw Bossy turn to the vehicle’s chief attorney and shot him. He took cover behind public toilets and called 911.

At around the same time, several residents also called to report the shooting.

When the police arrived, Vallandingham was arrested. They found Bossy sitting in the vehicle with gunshot wounds. Bossy was pulled out of the vehicle and life-saving measures were taken, but he was pronounced dead at the scene. The letter said that “a large knife fell out of Bossy’s right pocket and he was wearing blue rubber gloves.”

The only other witness to the shooting was Bossy’s employee, who told police they had used methamphetamine before heading to the waterfront to use a public toilet. Bossy told him he was going to steal Vallandingham’s car. His colleague drove on down the street. The agent said he saw Vallandingham approach the vehicle and fire the gun.

The letter said there was no surveillance video showing the shooting.

In summary, Vallandingham told police he believed his life was in danger when he fired the gun and Bossy was about to commit a crime while armed with a lethal weapon. “Because of the early morning darkness, any sane person would sound the alarm” and that Vallandingham was not unreasonable under the circumstances.
